New COBRA Legislation
 Does this affect you?
On December 19, 2009, President Obama signed a bill that extends the COBRA subsidies made available earlier this year under the American Recovery and Reinvestment Act (ARRA). Under this law, the Federal government pays 65% of COBRA premiums for a period of nine (9) months for individuals who were involuntarily terminated. In addition to some income limitations, eligibility was for individuals terminated between September 1, 2008 and December 31, 2009.

Under the new provisions:
  • The end date for eligibility has been extended from December 31,  2009 to February 28, 2010.
  • The subsidy period has been extended to 15 months, up from 9 months.
  • Coverage is extended to former employees whose original subsidy expired.  Those individuals who lost their subsidy because they were at the end of their 9 months in November, 2009 or later are grandfathered under the new law and may receive six more months of  assistance.
  • A new notification is required within 60 days, outlining the changes to all individuals eligible for COBRA on or after October 31, 2009.

Make-A-Wish Foundation reminds public that it

does not engage in telemarketing

 

( COLUMBUS , OH ) ­– The Make-A-Wish Foundation® of Greater Ohio, Kentucky and Indiana , Central Ohio Region, has received a number of complaint calls from Columbus area residents who have been contacted by telemarketers claiming to raise money for the chapter.

 

“As a matter of national policy, the Make-A-Wish Foundation does not engage in telephone fundraising for several reasons, including a desire to keep its fundraising expenses low and because so many people find the practice invasive”, said Tim McCarthy, executive director of the Make-A-Wish Foundation, Central Ohio Region.

 

“In the past week, we have heard from quite a few individuals complaining that they’ve received telephone solicitations from telemarketers who claim to be affiliated with the Make-A-Wish Foundation,” McCarthy said.  “The simple answer is that we do not, and would not, authorize any telephone solicitations on our behalf.  We prefer to use our funds for granting children’s wishes, rather than paying telemarketers.”

 

McCarthy is asking anyone who receives one of these calls to: 1) not make a donation if a telephone solicitor claims to be working with or for the Make-A-Wish Foundation, and 2) contact the Make-A-Wish Foundation office at (614) 923-0555 to share their experience.

 

“Contacting the chapter office will help us understand the nature of these telemarketing calls, as well as when and where they are occurring in our area,” McCarthy added.  Approximately 80 percent of funds raised by the Make-A-Wish Foundation of Greater Ohio, Kentucky and Indiana are used to support program services, including wish granting.   McCarthy said that part of the reason the chapter is able to maintain its excellent expenses ratio is because it does not employ telemarketing.

December 21, 2009 Health Insurance Open Enrollment Program Accepting Enrollees Starting January 1
New state rate-cap reform measure estimated to cover 52,000 more Ohioans
Columbus, Ohio A new Ohio law that has made it possible for an estimated 52,000 additional adult Ohioans to obtain health insurance becomes effective on January 1, 2010, said Ohio Department of Insurance Director Mary Jo Hudson.
The reform puts a rate-cap in place so that more Ohioans can secure basic health coverage through the state-mandated Open Enrollment Health Insurance Program. Insurers are limited in how much they can charge people with diabetes, cancer and other pre-existing or chronic conditions who purchase individual health policies from private insurers through the program. Following a phased-in approach, a cap on rates may eventually be 1 1/2 times the lowest rate charged to a person of similar age and gender. This change is eventually expected to reduce open enrollment premiums by at least 50 percent.
“This is a positive step toward decreasing the number of Ohioans without health insurance and making coverage more affordable and available to everyone in the state,” Director Hudson said. “This was one of several health coverage reform measures contained in the state’s recently enacted state budget bill that could help 109,000 now uninsured adult Ohioans obtain coverage.”
Ohioans are encouraged to visit the Open Enrollment Health Insurance Program Toolkit on the Department’s web site at www.insurance.ohio.gov for a list of the approximately 25 insurers in the program, and company contact information (web addresses will be posted January 4). Ohio insurance consumers can also contact an insurance agent for information. Insurers have an annual quota beginning January 1 and once an insurer meets its quota of people enrolled in coverage through open enrollment, the insurer is not required to accept additional applications until the insurer falls below the quota.
Certain insurance consumers who have lost their coverage need to secure new insurance within 63 days or a 90-day waiting period for coverage to begin and a 12-month waiting period for treatment of pre-existing medical conditions likely will be applied by most insurers.
Those deemed as a Federally Eligible Individual (FEI) will have the waiting periods waived. You are considered an FEI if:

  1. You have 18-months of creditable health coverage (an employer group health plan, Medicare, Medicaid and COBRA) and your most recent coverage was through an employer.
  2. You have exhausted all continuation of benefit options (such as COBRA).
  3. Your old coverage did not terminate due to nonpayment of premium.
To have immediate coverage, an FEI must be enrolled in an open enrollment plan by midnight of the 63rd day after losing the old coverage. A copy of the certificate of coverage from the previous insurer must be provided to the new insurer in order to have the pre-existing condition period waived.

Join us Tuesday January 19th 2010 from 2 – 3:30 P.M. at the Ohio State University’s Columbus campus’ Gateway building room 421, 1590 North High Street for this free session sponsored by ADA OHIO for the Great Lakes DBTAC and hosted by OSU’s Integrated Disability Services and the Office of the ADA Coordinator.

The rights of people with disabilities who use service animals vary, depending on which law applies. The Americans with Disabilities Act, the Air Carrier Access Act, and the Fair Housing Act each have different standards for service animals and their owners. Complicating the topic even further is the issue of the definition of service animals, especially in relation to emotional support or therapy animals. This session will provide information about the definition of service animals and the rights of service animal owners under the ADA, the ACAA, and the FHA. We will also discuss the differences in how the various laws treat service animals versus emotional support or therapy animals, as well as model service animal policies for educational institutions and healthcare facilities.
